How do you define illegal building ....a building on a land having No NA layout or certificate or a building built on a NA layout approved plot but exceeding the building byelaws...I the former is in question then I would vouch for not legalising the illegal buildings but if the later is in question then I have a strong belief that those buildings should be legalised.one simple thought is required that is a building on a approved layout plot(piece of land) is being built it will be naturally with a duly signed approved building layout...and what will be the outcome at the time of completion will be 30% more than the built up area...which I think is already considered in the calculation of the population density per acre by the urban planning dept. The reason for supporting the legalising buildings which are built on a legal piece of land with duly signed building permit is that a person who developes a piece of land 30% more than the FSI does it through encroaching the balcony, Boxes and the staircase lobbies and then 10% in the FSI, and all this can be accomodated with the building byelaws, also If I am not wrong the building byelaws front page clearly says that it is a guideline for building permit and not a law.

In residential layouts comprising of plots of various dimensions, in good old days people used to build homes as per the building byelaw. Coverage, FSI, front back and side setbacks every thing as perbye law. AS one may be aware the solialistic approach results in layouts having plots of different dimensions like 20' x 30"; 30' x40' ; 40'x60', 50'x80'; 60'x120' or similar sizes. In Housing Board Colonies we used to have on a 18m wide road on one side Middle income group 2 bed houses and on the other EWS 0 bed houses. Similarly on 24m wide Road we used to have on one side HIG houses and on the other side LIG single bed Houses. Fair enough. Purpose is Low income and EWS ategory people will learn from their MI and HI brothers on how live a good life, moral values, about hygene, leanly ness etc. Learn from thy neighbour is the theme. But What is the reality. HIG people generally had small family since children used to be in bording school and old parants in old age homes, and HIG house had three bathrooms and MIG people had slightly bigeer family where parents also used to live with their sons and would take are of gradn children and had two bathrooms. As against this Low inome group people used to have more than 2 children if they had successively 3 daughters they would be again trying for a male child and have 4th 5th and so on. parnts of son. In case of EWS houses, probably unmarried sisters and brothers also would be there in the same house and only one bathroom. Early morning scene in such KHB localities will be EWS and LIG people waiting in ques for getting water, kersosene etc. All children up to may be 5years age on road side with out any cloath on them using the roadside as toilet and HIG or MIG people had ready sevants just infront f their house and EWS/LIG people had ready house servant jobs in front of their house. Soon people started Voilating the building byelaws and construct more rooms for their own use. Litle later people with out knowledge of any other avenue for investment though of building more rooms for giving it on rent. MIG and HIG people also learnt from EWS and LIG people and started constructing and expanding more area so that they can rent it out and that is the safest way of earning income and investment. If you invest Rs 1 lakhs to construct an additional room in first few years you may earn only 5% on your investment and as the years pass return on original investment will improve beause of higher rental redued property tax beaus eof the depreciation allowance. And appreciation of the value of the property would result in getting back your investment with returns as high as 20-25% per year if you sell the house after few years. So instead of LIG and EWS people learning from MIG anf HIG people, it is HIG and MID people learn from EWS/LIG people how to make money. Now the Governments in Power suddenly wakes up beause they dont have enough money to pay salary to Goverment employees and to buy helicopters to do arial surveys and to build helipads or buy new laxury cars for Ministers so they will come out with a sheme for the Am Admi called Akrama - Sakram where all voilations will be legalised by leavying a penalty on the voilator. All offcials who are responsible and the politicians behind permiting the voilation by just sleeping over the matter by taking bribe are left out of any punishement. A really law abiding person who didnot voilate but got affected beause of voilations on all three sides of his house with out proper ventalation and light entering his house will not get any compansation. He got punished by god for not fighting so far by way of loosing few years of life caused by more polution, poor light and ventilation.

I agree with you fully. Government should strict action against all persons involved in such activities like the official who is sleeping over encroachment activity, the politicians who are responsible to posting suh oofiers by taking bribe, the persons who are purhasing properties with out proper verifiation and reord, persons who are selling suh properties, enroachers of public properties and creators of falls documents for such properties, and so on whole country is involved we are living in such a country. But we had to teah our children about the nation and NATIONAL PRIDE.

Hi Laxminarayana, interesting debate. According to me we should not legalize the illegal construction, this will lead to many accidents. The government should demolish such buildings and should not give permission for constructing illegal buildings. They should check whether everything is followed as per the policies of the government and then give approval for constructing. Thanks.....
